My friends told me that Hearthstone actually have a Pity Sistem - if you don't open a legendary in the first pack, the chances of open it rises at the second, third until 40º, then, you open one. 100% sure
But I opened one in the FOURTH pack. Hearthstone really have it or it's aleatory?

It exists just that some players blizzard likes and give them everything and some players like me get exactly the pity timer....
Pity timer is exactly that.. if blizzards hates you.. you get at minimum a legendary per 40 packs.. I got a friend like you who gets golden legendaries all the time while I get 40 dust all the time and sometimes Iget.. golden... Common.
The legendaries that you open are not important enough to put in your signature for everyone to read and they definitely are not important enough to take down the the established and statistically proven pity system.
So, yes, the pity system does exist, but you already knew that. As you said, the chances improve as you open packs but that doesn't mean that you can't get a legendary in the first or second pack, it's only less likely.

There hasn't been recorded a pack opening that didn't contain a legendary within 40 packs, many times exactly at the 40th pack. Not 41st, 42nd, 43rd, exactly 40th. The proof is there, it's absolutely intentional that you are guaranteed one in 40 packs.
I don't believe that the game has a pity system. It is calculated that it is literally IMPOSSIBLE to open forty packs without getting a legendary, but as you get higher and higher in levels and ranks, it seems that the number of legendarys that you open slowly gets more an more spaced out. It could be that as you get more legendarys that the game says that you need other cards other than legendarys. This happened to me when I strarted a new account, and I opened Tirion Fordring, Ragnaros Lightlord, Prophet Velen, Fandrall Staghelm, and Boogeymonster in 13 packs.

After that, nothing until maybe two weeks later.
This is the difference between using large samples and small samples.
The pity timer finding is the result of testing tens of thousands of games over several months and determining that, as said, it's literally impossible for a person to go beyond 40 packs without a legendary. That's statistically improbable as, among that big a sample size, SOMEONE is going to hit variance and go 41+ packs without one. Thus it highly suggests that there is a system manipulating the odds.
And note the finding is NOT that it increases your chances. You get the same % chance of getting a legendary (1% per card, thus 5% per pack) . But if you somehow manage to open 39 packs of the same set (doesn't have to be sequentially) without a legendary, the 40th pack WILL have one.
In contrast, the theory that you ge tmor elegendaries earlier on than later based on one person's impressive findings is contradicted by my experience as I had NOT gotten a single legendary in my first 20 or so packs and had ot go for a while without many in the first few months. My most regular time getting legendaries came after about 6 months when at one point I got 2 legendaries, one golden, in one pack, then kept seeing them comming. Nowadays, it's above average (average is 1 per 20 packs, and I can see about 3-4 in 40 packs).
But really don't use random people here telling canned phrases. There's big time data on this. Go read it here:
Note that though the information was first gathered during TGT,despite the many many videos of pack openings we've had yet to see anyone post video proof of opening 40 packs without a legendary within it, and really all it takes is ONE to blow the theory out the water.
Note also that there's no information pre-TGT so we don't nkow if the timer existed before TGT. The popular belief is that it was stealth added in TGT though for all we know it could've been in existance from the beginning. However, as far a statistics go, what they have is more than enough to show that it's not RNG being RNG.
As of today, I opened 80 TGT packs and opened Aviana, The Skeleton Knight, The Mistcaller, Confessor Paletress and Rhonin in 80 packs. The distance between them was around 10-20 packs each. Yes, there is that pity timer but it depends on how lucky you get. I've opened only a dupe legendary from the Old Gods set and currently only 4 missing and only 4 crafted(from WoG). It depends on your "luck" with packs. With the TGT packs I've opened The Skeleton Knight like the 4th time now in at about 500 packs.
