Because it's garbage with everything that isn't hydra/foe reaper? In the late game, your first attack normally goes into a divine shield, so having +10 attack on your first attacker doesn't really matter.

Spiteful is just so key to the decks that are playing it. To give it a harder nerf would kill those decks
