Nope, afaik you are guaranteed to get one every 40 packs you haven’t opened one. The pity timer only triggers when you open 40 packs and fail to get a legendary, not every 40 packs no matter what, if that’s what you’re getting at. Also, I’m pretty sure it’s been a thing Blizzard has talked about.
EDIT: And at least once during your first 10 packs of an expansion, when you haven’t opened any yet. So, you’re guaranteed one in your first 10, then guaranteed one in every 40 from there on.
actually pity timer has never been talked about by Blizzard. Probability is a thing and it is just that in 40 pack, the chance of never getting a legendary is so low it is basically zero. Infact, some people have say that they went over 40 pack without a single legendary.
The only thing is No one believe these people. and in their 41,42,43 packs, they get them.
This doesn't means that they miscounted. When the chance is so high to get legendary after 40 pack, of course they will get a legendary in a few more pack.

Blizzard intended to reset the timers for a very large portion of the playerbase to begin with, then even admitted that they fucked up and I'm pretty sure announced so publicly, even. Buying packs then is absolutely not cheating (as that would entail you gaining an unfair advantage over others, which wasn't the case as literally EVERY player had their timers reset and had the chance to pick the legendaries up). Besides that, something like this more than likely brought Blizzard way more money than they possibly ever could have lost from people not giving them money in the first place, as paying customers often just bought 10 packs and the others wouldn't give them money ever anyway.
It's not like this kind of thing would actually hurt this multi-million dollar game in the least anyway. It's more of a PR move than an exploit.

When the average chance of getting a legendary is at 1 per 20 packs (confirmed by blizzard) natural probably would mean getting past 40 packs would NOT be that rare of an occurrence. It would be more common than, say, Knifejuggler hitting the face 3 times against a full board (Which we have video evidence of).
You CANNOT have over 10,000 people fail to break 40 packs, then have not a single person post video evidence or even an easily-faked up tracking sheet of card draw tracking showing 41 packs were reached, and it be probability. And I'm NOT exaggerating on the 10k people. That's the sample that was pulled back in TGT which is how we found out about the pity timer in the first place.
Furthermore blizzard HAS confirmed that the actual percentage changes based on the packs you open. That is, as you open more packs, you are more likely to get a legendary in your next pack. No, that's NOT 'common probability'. If you open 20 packs and get nothing you don't have a higher chance of getting something next time if normal RNG is involved. That's not the only evidence we have but the post is already an essay.
Point is, we have a lot of info suggesting the timer. We also have blizzard confirmations that a system like a pity timer exists. Meanwhile all it takes is one person to break 40 at any point between 2015 and now. Even a person with a spreadsheet would be SOMETHING even if we could argue if it's legit. Not ONE has even done that. Many swear they will though. So far I've heard everyone who've tried ended up proving the timer.
Sidenote, the one time the pity timer 'reset' due to a bug was when they added in the 'guarantee at 10' system. It was supposed to grandfather everyone, thus those who alrady opened packs wouldn't start at 'pack 1'. For A LOT folks (including me) it 'reset' thus letting us get a legendary within 10 packs. I haven't seen it happen since then but it is proof it CAN happen again.

They never announced the bug publicly we found it out ourselves. It wasn't even a bug just some unintentional side effect.
