You can't see it but you can count for yourself how many packs have you opened from a specific set without a legendary. And it's an algorithm, it knows when did you open your last Leg.
And it means you are guaranteed to get a Legendary in every 40 packs at worst (from a specific card set, not overall).
Whenever you open a legendary card, an invisible timer begins counting. It goes up every time you open a pack with no legendary. Once it hits 40, you're guaranteed a legends legendary in the next pack. You can't see the timer, and there's a separate timer for each expansion.
You can't see it anywhere, but it has been proven by a large statistical samples that you will always get a legendary upon opening 40th pack after your last opened legendary in the worst case scenario. It is every twentieth pack on average. Just keep in mind that each set has its own pity timer which means if you open 20 packs from KoFT and 20 from KaC you are not garanteed a legendary! HTH
So this isnt one you can see per se, however through community efforts it has been learned that within any set when you open packs you will go no more than 40 without receiving a legendary.
How it knows which one to give you is based on your collection and they have a system in place that pulls from cards you don't already own (see no duplicates rules).
Though Blizzard has never confirmed outright that this exists a while back they did subtly say that people weren't getting legendaries when they should have giving a nod to the fact that it exists.

Thousands of pack openings were examined to try to find the 'unluckiest' person - the person who opened the most packs without getting a legendary card. It was noticed that the number stopped abruptly at 40. If it was random, there would be a bell curve out to infinity - it would be extremely rare, but some poor schmuck would eventually open 1000 packs without a legendary. In practice, it has not been observed in the data.

I can't personally say anything about the golden pity timers because I don't count my packs for those, so I don't personally know how accurate those are, but I believe it. I can honestly say that I definitely never opened a legendary or epic after 40 or 10 packs respectively since I started counting.
On a side note, GOLDEN Legendaries do NOT count towards your regular legendary pity timer. In other words, they are independent and will not reset the timer.

We don't know that's how it's coded. What we do know by sampling data is that opening a legendary becomes more and more likely at an increasing rate the longer you go without one until it becomes a certainty at pack 40.
There are sources statistically proving this is how it works but I get tired of retrieving the links every time someone disputes it.

To add to this the golden legendaries are on a separate timer. In fact, ALL of the items have their own timer (epics, legendaries, golend commons, golden epics, ext..).
As far as blizzard confirmations, they HAVE confirmed that the rate of legendary cards increases with each successive pack opening. They have also, indirectly, confirmed that there's a point when you SHOULD get a legendary according to the system. So they effectively confirmed a pity timer with increasing rates and an guarantee at a certain point. The only 100% unconfirmed item is the actual end number, the '40 pack'.

1. There IS a span of packs called pity timer for every expansion. 2. In expansion you never opened a pack from yet, you have a chance to get legendary in first 1-10 packs. 3. Then you got span of 1-40 packs for the next legendary. Every time you open a legendary, this span resets for 40 packs. (If someone opened legendary in two or more consecutive packs, then this person is SO DAMN LUCKY and got the span reset twice or more times.) 4. To keep records for your packs I recommend pitytracker.com.

It's a seperate Timer for each expansion - so you need to open 40 packs of ONE expansion for the pity timer to kick in.
