Even if the formula is about as good as we think it is or better, it will hurt sales as there will be a stronger understanding of how to "game" the system with optimal buying patterns. Remember, too, that not everyone who plays/pays is aware of the mechanics the community understands about the packs and if they knew it may change what and how they spend. It also means that in the future they would have to publicize how the drop system changes if they want to change it, and people will invariably demand to be compensated for purchasing packs a day/week/month before the change and creates lots of customer service work for the company.
Regardless of how guilty or innocent Blizzard's drop system is, this is only destined to result in headache. Naturally, a company will avoid this.

However, in regards to using the "legal hole", it was not a major restructuring. Blizzard has plenty of systems to give players items already and didn't need to do much more than tie a script to the end of the completed app transaction. Truly a small price to pay considering how much it can save them.
1. It immediately ducks the threat that new legislation could catch them with their pants down and they wind up in legal trouble before their programmers can code in a new monetization system and the legal and marketing teams now have plenty of time to discuss the future of the marketplace.
2. The sooner they implemented an updated system, the longer they operate in a marketplace somewhere in the world where smaller companies will close their marketplace for a while to catch up. This is small, but could wind up netting sales.
3. The drop formula is still secret. Competitors don't know how it works, buyers aren't crunching numbers or clogging customer satisfaction hotlines over the newly released data, and their revenue stream is largely uninterrupted.
Again, while this is clearly not done in the best interest of the buyer, businesses never do things in the best interest of the buyer. That's not how making money works. You need to sell things. This move is a good idea from the perspective of a company and has the benefit of not being excessively greedy.

There is no reason to assume packs are random, given the inherent difficulty in making a truly random algorithm, the fact there is a lot of evidence that the pity timer exists (which is by definition not random), the sophisticated algorithms they are using to adjust arena drafts, and most of all that they are profit driven company. Whatever drop rate maximizes pack buying will be favored. If too many good meta cards are found, pack buying will go down as players will have those cards and lose incentive to purchase, too few and customers might become frustrated and leave. I am hundred percent certain they put more effort into testing that than balancing tavern brawl for example(LOL Sindragosa).
