Does anyone know whether the pity timer or opening packs is set independent?

If I open 39 packs in the Classic set (and not get a legendary), would the pack I open for Journey to Un'Goro guarantee me a legendary?

It's separate for each pack type. In your example, the answer is no.

I dont know for sure, but I think i've heard it would only guarantee a legendary in the classic set

Separate for each expansion.
